New rules for renting property in Spain<\/h2>\n

The fact is that this new law comes due to the increase in the price of many rents, given the rise in inflation and the commodities crisis. This has affected many people who have seen how their rents have risen exponentially compared to previous years, to the point where they have had to leave the place because they cannot afford it.<\/p>\n

That is why, in order to regulate this situation, this new rental law has been passed. Here is a summary of the most important points.<\/p>\n

Regulation of renting in stressed areas<\/h2>\n

These rental tensioned zones, which are mainly in the big cities and which will also be extended with the new law, will now have a limit. The indexation of the price of the previous rent<\/a> cannot be exceeded, i.e. if the previous tenant paid 800 e, the present tenant will not be able to pay more than that 800 e.<\/p>\n

Only the percentage of the index in force will increase, which will be 2% in 2023 and 3% for 2024. The percentage from that year onwards will be the responsibility of the governments of each Autonomous Communities.<\/p>\n

In addition, it is prohibited to increase the price of rent with derived expenses that are not directly related to housing, such as community fees, garbage service, etc.).<\/p>\n

Evictions, more protected<\/h2>\n

No more evictions without prior notice and without a specific date. In addition, the state’s monetary funds dedicated to housing can be used to avoid these cases, and new extensions of up to 2 years will be established to give tenants more time to solve their situation.<\/p>\n

Change in the paradigm of large tenants<\/h2>\n

Being a large residential tenant may seem like a big deal. But with the new law, it won’t be. From now on, large rental tenants will be legal entities or individuals who own 5 or more properties. Those with less than that amount will be small landlords<\/a><\/strong>.<\/p>\n

What are the drivers of the new rental law in Spain?<\/h2>\n

The shortage of housing supply and the delay in the emancipation of young people are two of the main reasons for the creation of the law, apart from the people who were already living in rented housing<\/a><\/strong> and can no longer afford it.
