Le droit est d&#8217;abord d\u00e9fini comme un droit de premier refus, qui implique une communication pr\u00e9alable avant toute transmission. La Generalitat peut exercer ce droit de r\u00e9tractation si la communication n&#8217;a pas \u00e9t\u00e9 effectu\u00e9e correctement ou si ses conditions n&#8217;ont pas \u00e9t\u00e9 respect\u00e9es.<\/p><h2>Crit\u00e8res pour \u00eatre consid\u00e9r\u00e9 comme un grand d\u00e9tenteur<\/h2><p>Selon la loi 12\/2023 du 24 mai pour le droit au logement, un grand d\u00e9tenteur est consid\u00e9r\u00e9 comme :<\/p><ul><li>Les <strong>personnes morales<\/strong> propri\u00e9taires de plus de 10<a href=\"https:\/\/www.locabarcelona.egluu.com\/fr\/\"> immeubles r\u00e9sidentiels urbains<\/a> situ\u00e9s sur le territoire de l&#8217;\u00c9tat, \u00e0 l&#8217;exclusion des garages et des d\u00e9barras <\/li><li>Les <strong>personnes physiques<\/strong> ou morales qui poss\u00e8dent 5 propri\u00e9t\u00e9s ou plus situ\u00e9es dans des communes d\u00e9clar\u00e9es comme zone de march\u00e9 r\u00e9sidentiel en difficult\u00e9.<\/li><\/ul><p>De plus, ceux qui ont une superficie construite de plus de 1 500m2 destin\u00e9e \u00e0 un usage r\u00e9sidentiel, \u00e0 l&#8217;exclusion des garages et des d\u00e9barras, sont consid\u00e9r\u00e9s comme un grand d\u00e9tenteur.<\/p><h2>D\u00e9compte des logements dans les cas sp\u00e9cifiques<\/h2><p>La loi d\u00e9finit le &#8220;grand d\u00e9tenteur&#8221; comme toute personne ayant des droits sur des logements lui permettant de les utiliser, d&#8217;en profiter ou de les g\u00e9rer. Malgr\u00e9 ce que pourront d\u00e9cider les administrations et les tribunaux par la suite, plusieurs situations se pr\u00e9sentent :<\/p><h3>En situation de copropri\u00e9t\u00e9<\/h3><p>En copropri\u00e9t\u00e9, tout d\u00e9pend du pourcentage d\u00e9tenu :<\/p><ul><li>Si une personne poss\u00e8de 50 % ou moins d\u2019un bien (par exemple 25% ou 50%), elle ne dispose pas seule du pouvoir de d\u00e9cision quant \u00e0 son usage ou sa jouissance. Toute d\u00e9cision requiert l\u2019accord de la majorit\u00e9 des copropri\u00e9taires.<br \/>En revanche, ses parts sont prises en compte proportionnellement dans le calcul de la surface totale b\u00e2tie de 1 500m\u00b2. Ainsi, si une personne poss\u00e8de 50% d\u2019un appartement de 100m\u00b2, seuls 50m\u00b2 seront retenus dans le calcul global de ses surfaces d\u00e9tenues.<\/li><\/ul><p>Si une personne d\u00e9tient plus de 50 % d\u2019un bien, elle en a la majorit\u00e9 et le pouvoir d\u00e9cisionnel. Dans ce cas, le bien est compt\u00e9 comme un \u00e9tage complet pour le calcul du nombre de propri\u00e9t\u00e9s, tout en continuant \u00e0 \u00eatre pond\u00e9r\u00e9 selon le pourcentage d\u00e9tenu pour le calcul de la surface totale b\u00e2tie.<\/p><h3>En situation d&#8217;Usufruit et nue-propri\u00e9t\u00e9<\/h3><p>Les biens d\u00e9tenus en nue-propri\u00e9t\u00e9 ne sont pas pris en compte, ni pour le calcul du seuil de 5 ou 10 \u00e9tages, ni pour celui des 1 500m\u00b2 de surface b\u00e2tie. En effet, ce type de propri\u00e9t\u00e9 n\u2019accorde pas le droit d\u2019utiliser, d\u2019occuper ou d\u2019administrer le bien au quotidien. <\/p><p>\u00c0 l\u2019inverse, les biens d\u00e9tenus en usufruit sont int\u00e9gralement pris en compte dans ces calculs. L\u2019usufruit conf\u00e8re en effet le droit d\u2019usage, de jouissance et d\u2019administration du bien, ce qui \u00e9quivaut \u00e0 en avoir la pleine disposition pendant la dur\u00e9e de l\u2019usufruit.<\/p><h2>Comment se d\u00e9roule la proc\u00e9dure ?<\/h2><p>Le notaire ne peut pas autoriser la vente d&#8217;un logement situ\u00e9 en zone tendue sans v\u00e9rification pr\u00e9alable. Pour cela, il demande un certificat au Cadastre recensant tous les logements appartenant au vendeur.
